Terms of service

This English translation is provided for convenience. In the event of any discrepancy, the French version prevails.

These general terms and conditions of sale (“T&Cs”) govern any order placed on the website sayeyewear.myshopify.com (the “Site”), published by SAY (“SAY”, “we”). Any order implies unreserved acceptance of these T&Cs.

2. Products

SAY offers glasses with neutral, non-prescription lenses that have a blue light filter coating. These products are not medical devices and do not replace vision correction equipment prescribed by a healthcare professional. Photographs and descriptions are as accurate as possible; slight variations in colour may occur depending on the screen used.

3. Prices

Prices are shown in euros, including all taxes. Delivery is free anywhere in mainland France. SAY reserves the right to change its prices at any time; the applicable price is the one displayed when the order is placed.

4. Orders

An order is confirmed once the T&Cs have been accepted and payment has been confirmed. A confirmation email summarising the order is sent to the address provided. SAY reserves the right to refuse or cancel any order in the event of a previous dispute, suspected fraud or product unavailability; in the latter case, the customer is informed and refunded as soon as possible.

5. Payment

Payment is made online, when the order is placed, using the payment methods offered at checkout. Transactions are secured by Shopify's payment provider; SAY never has access to the customer's bank details.

6. Delivery

Orders are shipped from France within 24 business hours after payment confirmation, to mainland France only. Indicative delivery times are detailed in our shipping policy. If a parcel is damaged on receipt, the customer is asked to make a note of it with the carrier and to contact us within 48 hours.

7. Right of withdrawal and returns

In accordance with articles L221-18 et seq. of the French Consumer Code, consumers have a legal period of 14 days from receipt to exercise their right of withdrawal, without having to give a reason. SAY extends this period to 30 days. The terms (condition of the product, procedure, costs and refund times) are described in our return and refund policy. To exercise this right, simply inform us with an unambiguous statement, by email to sayeyewear@gmail.com or using the withdrawal form reproduced in the appendix below.

8. Legal guarantees

Independently of any commercial guarantee, all our products benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code, two years from delivery) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). To make a claim under a guarantee, write to us at sayeyewear@gmail.com, attaching your order number and photos of the defect.

9. Liability

SAY cannot be held liable for non-performance of the contract in the event of force majeure, an act of the customer, or an unforeseeable and insurmountable act of a third party. Amber lenses (“evening” models) alter colour perception and are not recommended for night driving.

10. Personal data

The data collected when an order is placed is necessary for processing and delivering it. Its processing is described in our privacy policy.

11. Mediation and applicable law

These T&Cs are governed by French law. In the event of a dispute, the customer is invited to contact our customer service first. If no amicable solution is found, the consumer may use a consumer mediator free of charge, in accordance with articles L611-1 et seq. of the French Consumer Code.
